Digital Currency and the government tracking and controlling your purchases

In America, the government tracking your purchases is against the 4th amendment. The Fourth Amendment guarantees Americans the right to be “secure in their persons, houses, papers, and effects, against unreasonable searches and seizures,”

But in 2001 they passed the Patriot Act which directly violates your 4th amendment. Both online and with regards to purchases. This also points out how the government is purchases the data from private companies to circumvent the 4th amendment.

Lawyers should focus on fighting cases that involve the Patriot Act and direct violations of the 4th amendment to reclaim the proper requirement that the government needs a search warrent before obtaining your online activity. This should include purchasing this information from private companies. As private companies are already required by law to separate your activity from your identity.

The government should only be allowed to access information you have said in public or information you have told another individual and that individual revealed what you have said. 3rd parties to any conversation or transaction cannot reveald the content of those interactions. Unless a search warrant is obtained.

This concern is important as the whole purpose of the 4th amendment is to stop this behavior from emerging within our own government. But the legislature has slowly chipped away at it. Lawyers need to step up and reinforce the guard rails that the 4th amendment has clearly defined.
